Agreement to Terms

Welcome to Roamers! These Terms of Service ("Terms") govern your use of the Roamers mobile application and related services (collectively, the "Service") operated by Roamers ("we," "us," or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

Quick Summary:

• You must be 18+ to use Roamers
• Be respectful to other travelers
• Your content is yours, but we need rights to display it
• Don't do anything illegal or harmful
• We can terminate accounts that violate these terms
• Meeting people in person is at your own risk — the SOS feature is a convenience, not a monitored safety service (see §7)

1. Eligibility

1.1 Age Requirement

You must be at least 18 years old to create an account and use Roamers.

By using the Service, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into these Terms
• You are not prohibited from using the Service under applicable law

1.2 Account Restrictions

You may not use Roamers if you:

• Are under 18 years old
• Have been previously banned from our Service
• Are a convicted sex offender
• Are prohibited by law from using such services
• Intend to use the Service for any illegal purpose

2. Account Registration

2.1 Account Creation

To use most features of Roamers, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Keep your password secure and confidential
• Accept responsibility for all activity under your account
• Notify us immediately of unauthorized access

2.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activities that occur under your account
• Immediately notifying us of any security breach

We will not be liable for any loss or damage arising from unauthorized use of your account.

2.3 One Account Per Person

You may only create and maintain one Roamers account. Creating multiple accounts may result in termination of all accounts.

3. User Conduct

3.1 Community Standards

Roamers is a community for travelers. You agree to:

• Treat other users with respect
• Be honest in your profile and communications
• Use the Service only for lawful purposes
• Follow local laws when meeting other users

3.2 Prohibited Conduct

You agree NOT to:

Harmful Behavior:

• Harass, bully, stalk, or intimidate other users
• Send unsolicited sexual content or advances
• Threaten violence or encourage self-harm
• Discriminate based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin

Deceptive Practices:

• Impersonate any person or entity
• Create fake or misleading profiles
• Use photos that aren't of you
• Misrepresent your age, location, or identity
• Engage in scams or fraudulent activity

Illegal Activity:

• Use the Service for any illegal purpose
• Solicit money or valuables from other users
• Promote illegal drugs or activities
• Engage in human trafficking or exploitation
• Violate others' intellectual property rights

Platform Abuse:

• Attempt to hack, reverse-engineer, or circumvent security
• Use bots, scrapers, or automated tools
• Spam other users with unsolicited messages
• Distribute malware or harmful code
• Interfere with the Service's operation

Commercial Use:

• Use Roamers for commercial solicitation
• Advertise products or services without permission
• Recruit users for external services
• Collect user data for marketing purposes

3.3 Reporting Violations

If you encounter content or behavior that violates these Terms, please report it through:

We investigate all reports and take appropriate action.

4. Content Guidelines

4.1 Your Content

"Your Content" includes all information, photos, messages, and other materials you submit, post, or display through the Service.

You retain ownership of Your Content. However, by posting content, you grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to:

• Use, copy, modify, and display Your Content
• Create derivative works from Your Content
• Distribute Your Content through the Service

This license exists only for the purpose of operating and improving the Service.

4.2 Content Restrictions

You agree that Your Content will not:

• Contain nudity, pornography, or sexually explicit material
• Depict violence, gore, or graphic content
• Include hate speech or discriminatory content
• Infringe on anyone's intellectual property rights
• Contain private information of others without consent
• Violate any applicable law or regulation

4.3 Content Removal

We reserve the right to remove any content that violates these Terms or that we find objectionable, without prior notice. Repeated violations may result in account termination.

4.4 No Obligation to Monitor

While we may review content, we have no obligation to monitor all content posted on the Service. You may encounter content you find offensive; use the Service at your own risk.

5. Intellectual Property

5.1 Our Intellectual Property

The Service and its original content (excluding Your Content) are and will remain the exclusive property of Roamers. This includes:

• The Roamers name, logo, and branding
• App design, features, and functionality
• Software code and technical infrastructure
• Documentation and marketing materials

5.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and use the App on your personal device
• Access the Service for personal, non-commercial use

5.3 Restrictions

You may not:

• Copy, modify, or distribute our intellectual property
• Reverse-engineer or decompile the App
• Remove any proprietary notices or labels
• Use our branding without written permission
• Create derivative works based on the Service

5.4 Feedback

Any feedback, suggestions, or ideas you provide regarding the Service may be used by us without any obligation to compensate you.

6. Privacy

Your privacy is important to us. Our [Privacy Policy](/docs/PRIVACY_POLICY.md) explains how we collect, use, and protect your personal information.

By using the Service, you consent to our collection and use of data as described in the Privacy Policy.

Key points:

• We collect profile information and location data
• We use your data to provide and improve the Service
• We do not sell your personal information
• You can request deletion of your data at any time

7. Safety

7.1 In-Person Meetings

Roamers facilitates connections between travelers, but we cannot guarantee the conduct of any user. When meeting others in person:

Recommended Safety Practices:

• Meet in public places first
• Tell someone you trust where you're going
• Use the SOS flow (§7.2) to share your live location with an emergency contact before meeting someone new
• Trust your instincts — leave if you feel uncomfortable
• Don't share financial information
• Remember that another user's profile, photos, and stated location are not verified by us (§7.3)

7.2 SOS Is Not Monitored

The app includes an SOS flow (reachable within two taps) that can call your local emergency number and start a time-boxed live-location share with your saved emergency contacts.

This feature is not monitored by Roamers. No one at Roamers sees, receives, or responds to an SOS action. It is a convenience for reaching the people and services you choose, faster — it is not a substitute for calling local emergency services yourself, and we make no guarantee that your emergency contacts will see or act on a share in time. Do not rely on it as your only safety plan.

7.3 No Identity Verification or Background Checks

We do not conduct criminal background checks on users, and we do not currently offer any identity verification feature (no ID check, selfie check, or social-account verification exists in the app today). Do not assume another user is who or what their profile claims. If we add a verification feature in the future, we will describe exactly what it does and doesn't confirm.

7.4 User Responsibility

You are solely responsible for your interactions with other users. Roamers is not responsible for the conduct of any user, whether online or offline.

7.5 Reporting Safety Concerns

If you experience any safety concerns, please:

• Report or block the user through the app immediately (available from their profile, a chat, or a hail)
• Contact local emergency services if you're in immediate danger — see §7.2, we do not monitor SOS
• Email us at hallo@makeitnice.de

We investigate reports made through the in-app report feature; response times may vary, especially outside of business hours, and are not a substitute for contacting local authorities in an emergency.

8. Premium Features

8.1 Current Status: Roamers Is Free

At launch, Roamers is free to use with no paid tier and no purchases available. Any in-app messaging that once referenced a "Premium" plan does not reflect an active subscription product.

8.2 If We Introduce Paid Features Later

If we introduce an optional paid subscription in a future version, it will be billed through your Apple App Store account, subject to Apple's own terms, and we will update this section to describe: what's included, billing and renewal, cancellation (via your App Store account settings), price-change notice, and any trial terms — before asking you to pay for anything. We do not process payments ourselves and never will store your payment details.

9. Third-Party Services

9.1 Third-Party Integration

The Service may integrate with third-party services, including:

• Google Sign-In for authentication
• Apple Sign-In for authentication
• Apple Maps for location features
• Apple's In-App Purchase system, if and when we introduce paid features (see §8)

9.2 Third-Party Terms

Your use of third-party services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

9.3 Links to External Sites

The Service may contain links to external websites. We do not control and are not responsible for the content or practices of external sites.

10. Disclaimers

10.1 "As Is" Basis

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

We specifically disclaim:

• Warranties of merchantability
• Warranties of fitness for a particular purpose
• Warranties of non-infringement
• Warranties that the Service will be uninterrupted or error-free

10.2 No Guarantee of Results

We do not guarantee:

• That you will find travel companions
• The accuracy of user-provided information
• The conduct or safety of other users
• Continuous, uninterrupted access to the Service
• That the Service will meet your expectations

10.3 No User Verification

As described in §7.3, we do not currently offer any identity verification feature. We do not:

• Conduct background checks
• Verify the accuracy of user profiles
• Guarantee user identities or intentions
• Screen for criminal history

11. Limitation of Liability

11.1 No Liability for User Conduct

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROAMERS SHALL NOT BE LIABLE FOR:

• The conduct of any user, online or offline
• Any content posted by users
• Personal injury or property damage resulting from use of the Service
• Any interactions between users

11.2 Limitation of Damages

IN NO EVENT SHALL ROAMERS BE LIABLE FOR:

• Indirect, incidental, special, or consequential damages
• Loss of profits, data, or goodwill
• Service interruption or data loss
• Any damages exceeding the amount you paid us in the 12 months prior to the claim

11.3 Jurisdictional Limitations

Some jurisdictions do not allow limitations on implied warranties or liability. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Roamers and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your Content
• Your violation of these Terms
• Your violation of any rights of another
• Your interactions with other users

13. Termination

13.1 Termination by You

You may terminate your account at any time by:

• Using the delete account feature in Settings
• Emailing hallo@makeitnice.de

Upon termination:

• Your profile will be removed from the Service
• Your data will be deleted per our Privacy Policy
• Active subscriptions should be cancelled through your app store

13.2 Termination by Us

We may terminate or suspend your account immediately, without notice, for:

• Violation of these Terms
• Conduct harmful to other users or the Service
• Fraud or illegal activity
• Any reason at our sole discretion

13.3 Effect of Termination

Upon termination:

• Your right to use the Service ceases immediately
• We may delete your account and content
• These Terms survive to the extent they should reasonably survive

14. Dispute Resolution

14.1 Governing Law

These Terms shall be governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you use Roamers as a consumer, this choice of law does not deprive you of the protection of mandatory provisions of the law of the country where you have your habitual residence.

14.2 Informal Resolution

Before filing any claim, you agree to try to resolve the dispute informally by contacting us at hallo@makeitnice.de. We'll try to resolve the dispute within 30 days.

14.3 Courts

If a dispute cannot be resolved informally, it will be decided by the competent ordinary courts. If you use Roamers as a consumer, you may bring claims in the courts where you have your habitual residence, and mandatory consumer-protection rules on jurisdiction remain unaffected. We do not require arbitration and do not ask you to waive class or collective actions.

15. General Provisions

15.1 Entire Agreement

These Terms, along with the Privacy Policy, constitute the entire agreement between you and Roamers regarding the Service.

15.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

15.3 No Waiver

Our failure to enforce any right or provision shall not constitute a waiver of that right or provision.

15.4 Assignment

You may not assign or transfer these Terms without our consent. We may assign our rights and obligations without restriction.

15.5 Modifications

We reserve the right to modify these Terms at any time. Material changes will be notified via the app or email. Continued use after changes constitutes acceptance.

15.6 Force Majeure

We shall not be liable for any failure to perform due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, or government actions.
